LIMITED WARRANTY TERMS AND CONDITIONS
LIMITED WARRANTY
The Company warrants that its Products, if properly stored and transported, will be free from defects in materials and workmanship, from the date of sale until the date the product is installed (“Warranty Period”). The purchaser will examine all products prior to installation. Please note- that the handmade nature of each Product results in natural variations. These variations are not to be deemed defects. If Products are found to be defective during the purchaser’s examination, the purchaser will provide a written submission to the company indicating the nature of the defect. Upon receipt of the purchaser’s written submission, if the Product is found to be defective, the Company will, at its option, replace the Product with one deemed equivalent by the Company, or refund the purchase price.
EXTENT OF LIMITED WARRANTY
The Company’s obligation is limited to the replacement or refund referenced above. Purchaser is responsible for all other costs, including but not limited to packaging, shipping, handling, and administrative costs associated with returning the replacement Product.
WARRANTY SERVICE
In order to obtain warranty service, the purchaser must submit a written notice to the Company within 5 days of Product receipt. The written notice of warranty service must be accompanied by1)a proof of purchase, 2)a signed copy of this Limited Warranty, 3)an explanation of the problem. This documentation is to be sent to Edgewater Studio Inc., 758 Copping Street, Suite 105, North Vancouver, British Columbia, V7M 3G6.
WARRANTY LIMITATIONS AND EXCLUSIONS
The Company’s obligation under this or any other warranty, implied or expressed, is limited to replacement, as set forth above. This remedy is the sole and exclusive remedy for any breach of warranty. The Company is not responsible for any indirect, special, incidental or consequential damages resulting from any breach of warranty, or any other legal theory, including but not limited to lost profits, downtime and any damages to or replacement of equipment and property. This agreement constitutes a final written expression of all the terms of this agreement and is a complete and exclusive statement of those terms. Any and all representations, promises, warranties or statements by the Company’s agents that differ in any way from this written agreement shall be given no force or effect.
GOVERNING LAW/ VENUE
This Limited Warranty shall in all respects be governed by the laws of the Province of British Columbia. Any action or proceeding seeking to enforce any provisions of, or based on any right arising out of this Limited Warranty, shall be brought against any of the parties in British Columbia Provincial Court.
- All of Edgewater Studio’s products are made to order.
- Our Art Glass Mosaic tile collection is not designed for immersion in water, or installation in areas subject to sources of extreme heat or cold.
ORDERING AND PAYMENT
- Due to natural variations inherent in glass, final products may vary minimally from samples.
- Ensure accurate measurement of the installation area. Due to natural variations in the raw materials, tiles added later can vary slightly from the original order.
- We recommend the purchase of an additional 10% contingency for all orders to allow for cutting waste which can vary between installations. Patterns that have an especially large repeat may require a 15% contingency.
- Orders are assembled tape-faced in sheets measuring approximately 10” x 10” for field tile.
- We will begin on your order upon receipt of the payment. Once work has begun on your order it cannot be canceled.
- We will ship the finished product typically within 1-2 weeks. Edgewater Studio will advise you of the shipment date and the tracking number via email.
SHIPPING
- We make every effort to minimize the cost of shipping.
- We ship our glass tiles boxed, via ground.
- We cannot ship to PO boxes.
INSPECTIONS AND RETURNS
- Please review Edgewater Studio’s Limited Warranty.
- Shipping damages and defects must be claimed within five business days of receipt of the tile. Please include photographs of all shipping damages.
- Samples are neither refundable nor returnable.
INSTALLATION AND CARE
- All of the requirements and recommendations for the installation and care of Edgewater Studio’s glass tiles are found in the Installation Guide.
- We recommend that the glass tiles be installed by a tile setter experienced in glass tile installation.
- Installation requires a premium, flexible, white mortar and unsanded grout. Glass tiles are easily cut with traditional hand tools, or a wet saw fitted with a glass cutting blade.
- Tile sizes are subject to a ± 1/16” total perimeter size variation.
